MUMBAI: The Madras High Court bench has dismissed a PIL seeking setting aside of Tamil Nadu Arasu Cable TV Corporation’s (TACTV) auction process for allotment of 23 slots in mid, super, and hyper bands to free-to-air (FTA) Tamil channels.

The bench of Justices S Manikumar and G Chockalingam dismissed the petition, saying that the petitioner had no locus standi to file it.

TACTV had issued a tender notice for alloting 23 slots in the mid, super, and hyper bands to FTA Tamil channels for telecasting throughout the state (except Chennai Metro Area and Coimbatore City) by collecting carriage fee.

The petitioner maintained that the tender had been called for only 23 of the 106 slots for fixing carriage fee for the channels, leaving behind prime band, semi-colour band, super band, and UHF band.

He also contended that the corporation had ‘discriminated’ against FTA channels as the tender had forced free channels to pay carriage fee.

As per the tender issued by TACTV, the successful tenderer would be given the contract for a period of one year or the date of implementation of Phase III of digitisation by the Ministry of Information & Broadcasting, whichever is earlier.
