The Arasu Cable TV Corporation has moved the Madras High Court to restrain the Telecom Regulatory Authority of India (TRAI) from taking any action against it, pursuant to and in terms of a press release dated December 10 this year, pending consideration of petitioner’s DAS licence applications dated July 5 and November 23 last year with the Union Ministry of Information and Broadcasting.

Petition came up before today. After listening to arguments of Advocate-General AL Somayaji, judge posted the matter for December 19, when Additional Solicitor General P Wilson will commence his arguments.

Petitioner’s interim prayer is to restrain TRAI from interfering with the transmission of Cable TV signals by the petitioner Corporation in Chennai Metro area.

Press release stated that in Chennai Metro area, transmission of analog signals is illegal and digitalization has to be implemented immediately, failing which the same will be switched off any time.

Chennai: The Tamil Nadu Arasu Cable TV Corporation (TACTV) approached the Ma­dras high court to rest­rain the Telecom Reg­ula­tory Authority of India (TRAI) from interfering with the transmission of its cable TV signals in the Chennai metro area.

After hearing arguments from advocate general A.L. Somayaji assisted by a special government pleader Abdul Saleem and additional solicitor general P. Wilson, Justice V. Dhan­apalan posted to December 19 further hearing of the petition filed by TACTV.

TACTV also sought to forbear the TRAI from taking any action against it pursuant to and in terms of the press release dated December 10, pending consideration of its digital addressable system (DAS) licence applications dated July 5, 2012 and November 23, 2012.

The TRAI had issued a press release conveying that in Chennai metro ar­ea, transmission of analog signals was illegal and digitalisation had to be implemented immediately, failing which cable TV connections will be switched off at any time.

According to Saleem, even after the lapse of 17 months, the Union government had not yet processed the application of the petitioner for DAS licence and arrived at a decision.

The Union government was well aware that now­here in the world was a we­lfare measure of transmitting cable TV programmes at Rs 70 available, and it was only due to political and commercial reasons prevailing in the state that it deliberately did not want to issue a DAS licence to the petitioner.

On the other hand, it was trying to im­plement digitalisation th­r­ough TRAI, despite being aw­are that the matter was sub judice.

Though there was no specific order of the division bench extending the interim order, the factual position was that the status quo prevailing on that day continues as on date.

Till the batch of petitions was disposed of, digitalisation cannot be forced on the petitioner, Saleem added.

As per TRAI, It is Arasu only not to show analog signal, Others (SCV) can show analog in chennai .

Ultimately, Arasu have no way but to convince SCV rather than TRAI if they really want to start their service..

TRAI have become none other than pure supporter of SCV..:wall

In upcoming elections, people will dethrone congress if TRAI dont allow arasu in Chennai..:angry
 
Central govt can do if it has the will for doing it, Trai is just like a middleman...

In english: Hon'ble Madras high court is ordered in favour of arasu cable. Ordered TRAI not to disconnect the non-digitized cable connections. Also ordered disconnection should not be done till the outcome of arasu cable's DAS application with center.

Arasu should first get bold and start serving the Chennai people people with full heart, the injury seems to be self inflicted and not caused by others, and every single move by Arasu till date only seems to be favoring the private MSO and this makes the private MSO a sole king.

Let's assume that the congress loses the LS 2014 and BJP wins with the Monopoly support then what will Arasu do?? Again keep complaining TRAI and Wait for another 5 years??

Arasu should first get bold and terminate those in Arasu who directly or indirectly favor the monopoly and put real efforts to give the service to the Chennai people.

When did Arasu start showing analogue cable in Chennai? It seems that they are filing these cases just of name sake.

How will the recent TRAI announcement affect Arasu when it doesn't even exist in the Chennai city? Infact the TRAI announcement would only affect SCV which shows analogue cable to over 90% of Chennai homes and Arasu's case will only benefit SCV to continue analogue for ever.

Already Madurai branch of Madras HC ruled in favor of Arasu over 1 year back and asked TRAI to offer DAS license to Arasu and still Arasu didn't start its service in Chennai and now Madras HC has directly supported them and only god knows when Arasu will ever serve the Chennai people.

Huh... instead of Arasu reaching out to people with their service we people are forcing Arasu to enter Chennai and all these seem to fell into deaf ears.

Well said..

But Trai seems to provide DAS license if they really need to digitise chennai..

Arasu also intented to start services as soon as possible..

So don't make this issue infavour of TRAI or I&B..
