MUMBAI: Makers of Bigg Boss have dragged Sun TV, Vedartha Entertainment Pvt. Ltd. and others to the Bombay high court against the telecast of the new reality show "Malayalee House". Sun TV, counsel Virendra Tulzapurkar on Thursday assured the HC that the channel would not telecast the show in any other language and on any other channel without giving four weeks notice to Endemol Group.

Endemol Group filed a suit in Bombay High Court against Sun TV Network Ltd. and four others seeking injunction to restrain them from exploiting, telecasting, publicizing or continuing to telecast the reality show "Malayalee House" which is allegedly infringing the Group's copyright in the production format of "Big Boss". The suit filed through law firm Naik, Naik and Company argued through its counsel Virag Tulzapukar that two ex-employees of Endemol India Pvt. Ltd allegedly incorporated a production house under the name Vedartha Entertainment and have misused the confidential information to produce "Malayalee House". It alleged that the southern TV program "is a rip-off of Big Brother / Big Boss". The employees were "Creative Consultant" and "Vice President-Non Scripted" and were involved in production of "Big Boss" hence were privy to confidential information in respect of the show, the suit said adding another ex-employee in his capacity 'Head, Corporate Development and Strategy' allegedly facilitated the grant of telecast rights of "Malayalee House" in favour of Sun TV.

"Big Brother" is one of the most popular reality shows which was created by Endemol Netherland B.V in Netherlands in 1998 and launched in 1999. The show had a unique, never seen before format where the contestants had to live in an isolated house, were filmed 24/7 and try to avoid eviction on the basis of public voting, competing for a cash prize to be awarded to the final survivor. It proved to be a hit among TV audiences and generated extremely high TRPs and considering such popularity, several seasons of "Big Brother" were produced and till date, shows based on the format of 'Big Brother' have been telecast in almost 43 countries. The Indian version was called 'Big Boss' and launched in India in November 2006.

For alleged infringement of its copyright the Group has now sought damages to the tune of Rs 10 crore from Sun.

The matter was placed for hearing today before Justice S J Kathawala. Endemol Group's counsel sought urgent ad-interim injunctive reliefs to restrain telecast though the show has been on air for more than 20 episodes. The matter will be heard on August 7 now.
