Discussion Channels with different programming for HD and SD variant

During NTO implementation, TRAI has mandated that "SD and HD version of same channel cannot be put together in a bouquet." (Source)

But many channels telecast different programs on SD and HD variants. Should this rule be removed from TRAI guidelines?

Some of this kind of channels are (please confirm/add to the list if you know more):

Sony MAX
Colors Cineplex
&Flix
&Pictures

Sony SAB
&TV

Eurosport
Sports18-1

Cartoon Network
Nick
Disney Channel

Zee Zest
TravelXP
 
Buddy read the latter part of the sams clause in NTO Regulations as it clearly states that if SD and HD feed air different programs then both feeds can be included in HD Bouquets by all broadcasters and right now too both Nick SD / HD, Times Now SD / HD and few other channels r all available in respective HD Bouquets of these broadcasters......

There r several other channels which can adopt this strategy as it shall not only expand reach of these channels but by offering some niche / different offering on HD channels it shall add unique appeal for people to subscribe to them....also they can simulcast important mass oriented content too which shall be simulcast as available on SD feed, there is no such restriction in NTO regulations as some overlapping is allowed , have to see if there is any ratio which is to be maintained as far as airing same content as SD feed on HD channels vs different content on HD channel for it to qualify for both feeds to be included in HD Bouquets but i don't think there is any upper or lower % limit set for the same
