MUMBAI: The DTH Association, Videocon d2h and Sun Direct have moved the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) against the Telecom Regulatory Authority of India’s (TRAI) tariff order capping the installation and activation charges for DTH customer premises equipment (CPE) at Rs 450.
The appeals have been put up for preliminary hearing on Friday. The DTH operators contend that the TRAI does not have jurisdiction to fix the tariff of CPE.
They also contend that the regulator has failed to consider certain cost elements like CPE refurbishment and call centre costs while recommending a standard scheme for CPE. They also argue that the installation/activation charges should remain uncapped.
The requirement of providing three years’ free service and maintenance to customers is without any basis, they say.
It is pertinent to note that TRAI had issued a fresh tariff order for CPE on 1 April as the previous tariff order issued on 27 May 2013 was set aside by the TDSAT on 1 October 2014.
The tribunal had asked TRAI to issue a fresh tariff order after considering the inputs provided by the DTH operators and addressing the issues thereof.
After receiving relevant information from the DTH players, TRAI issued a draft tariff order on 27 February 2015 seeking comments from stakeholders.
Following the consultation process, the authority issued the final tariff order. “We are already giving subsidy of Rs 3,000–3,500.
With this cap of Rs 450, we will bleed additional Rs 1000,” said Sun Direct MD and CEO Mahesh Kuma
