Gujarat HC to hear cable operators’ plea on 20 March
MUMBAI: The Gujarat High Court will begin hearing the matter pertaining to a writ petition filed by the Gujarat Cable Operators Association (GCOA) and Ahmedabad Cable Operator Welfare and Charitable Trust (ACOWC) challenging the Telecom Regulatory Authority of India’s (TRAI) tariff order for digital addressable system (DAS).
While the HC has posted the matter for hearing on 20 March, the case can come up for hearing before that. The two petitioners are also hoping that the High Court will take note of their request and hear the matter before the designated date.
“We will try to convince the court to hear the matter next week,” said GCOA general secretary Pramod Pandya. “The TRAI and the MSOs have failed to file their replies despite repeated reminders and delay in the case,” he alleged. Earlier, the HC had issued notice to TRAI and multi-system operators (MSOs) such as GTPL Hathway and IndusInd Media & Communications Ltd (IMCL) to file their replies to a petition filed by GCOA.
However, the TRAI and the MSOs have failed to file their replies despite many extensions, thus inviting a strong warning from the HC that it will proceed with final hearing in the case if they fail to file their replies.
The HC had set 13 February as the final deadline for TRAI and MSOs to reply to the petition filed by GCOA which was again breached. Notably, the court had issued fresh notice to TRAI and MSOs recently on a petition filed by ACOWC and the final deadline for filing the reply was 20 February.
However, the TRAI and MSOs once again failed to comply with this deadline as well.
The cable operators have challenged TRAI’s tariff order, contending that it is discriminatory towards them and infringes on their fundamental rights.
In particular, the billing and revenue share issues have irked the cable operators to no end.
