MUMBAI: Concerned with the slow pace of progress, the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) has appointed senior advocate Ramji Srinivasan as amicus curiae in the dispute between Amritsar Cable TV Operators Sangarsh Committee and multi-system operator (MSO) Fastway Transmission.
The tribunal has also appointed advocate Abhishek Malhotra to assist Srinivasan in the matter that took a new twist when a cable operator named Jaswinder Singh Jassi recently committed suicide alleging harassment by the MSO.
The order also stipulated that Srinivasan and Malhotra be provided with a complete set of brief (order sheets, petition, reply, MAs filed by both sides, etc.). The matter has been put up under the same heading on 15 April.
The tribunal said that the petitioner, which is representing small cable operators, cannot afford a protracted litigation and it is in their own best interest that the matter should conclude as early as possible.
“We have a feeling that the case of the petitioners is not being properly canvassed and we consider it desirable that the tribunal should get the assistance, apart from the respective counsel engaged by the parties, by a team of amicus curiae,” the tribunal in its order.
Noting that the petitioners had approached it 11 months ago with the grievance that they were being driven out of business by the overbearing and heavy-handed conduct of the respondent, the tribunal expressed its unhappiness over the way in which the matter is proceeding.
The tribunal’s observation came following a request by the committee’s counsel Dinesh Rawat to postpone the framing of issues. Rawat also wished to make an application for impleadment of certain other entities, of which one is an LCO and the other, a headend-in-the-sky (HITS) operator, even as Fastway counsel Navin Chawla was ready with the list of issues.
