MUMBAI: The Telecom Disputes Settlement & Appellate Tribunal (TDSAT) has directed DEN Networks not to disconnect any of the petitioners’ channels in digital addressable system (DAS) and non-DAS areas without issuing notices under the interconnect regulations.
IndiaCast UTV had moved the TDSAT, alleging that DEN has illegally switched off some of its channels in DAS and non-DAS areas without the issuing mandatory notice. The aggregator had also issued a disconnection notice against the MSO in January for non-signing of agreement.
The tribunal has directed DEN to immediately resume transmission of channels that have been disconnected without prior notice.
It has further stated that the channels must continue on frequencies that are viewable and usable in analogue transmission in order to qualify as not disconnected.
Contesting IndiaCast UTV’s allegation, DEN has told the tribunal that it did not switch off the aggregator’s channels but has merely put them on RIO (reference interconnect offer) and that too after issuing a public notice.
As far as non-DAS areas are concerned, the MSO contended that the channels have been put on UHF band, which cannot be construed as disconnecting the channels.
The tribunal has asked the MSO to file a short reply within a week and has listed the matter for 9 February.
The DAS and non-DAS agreement between IndiaCast UTV and DEN ended on 31 March 2014.
The negotiations for renewal of agreement did not bear any fruit as there was a stalemate on the issue of carriage fee.
IndiaCast UTV has alleged that the MSO wants the carriage fee to remain at the same level, if not increase. Rubbishing this claim, DEN has asserted that the aggregator wants subscription pay-out to increase and at the same time the carriage fee to reduce.
