The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has directed MSM Discovery, the now defunct joint venture between Sony and Discovery, not to give effect to its disconnection notice while ensuring that the West Bengal-based multi-system operator (MSO) Meghbala Cable and Broadband Services pays up.
The tribunal has asked MSMD to remove the on-screen displays (OSDs) running on the MSO’s network provided the latter makes an on account payment of Rs 50 lakh (Rs 5 million) to the respondent in two installments.
The first installment of Rs 25 lakh (Rs 2.5 million) should be paid by 15 June and the second one of similar amount by 30 June.
The payment will be without prejudice to the rights and contentions of the parties and will abide by the final outcome of these petitions, the tribunal said.
The MSO will also have to keep on making payment of the monthly subscription fees for the month of July 2015 onwards on the basis of the invoices raised by the respondent. Meanwhile, the tribunal has directed MSMD to file the reply by 3 July and rejoinder, if any, may be filed by 10 July.
