TRAI Order

On hearing the parties, we gather that the interconnect agreement between the parties has expired by efflux of time on 31.03.2018. It also appears that so far as parties have not been able to come to any negotiated terms for fresh agreement. The provisions of the interconnect regulations, 2012 are known to the parties. We expect them to act in accordance with law and move forward accordingly. However, we grant 10 days’ time to the respondent to file reply or a short reply.

Post the matter under the same head on 18.04.2018.

The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) on Thursday directed Asianet Satellite Communication Ltd. which requires an agreement on one basis or the other to enter into written interconnect agreement with Star India Pvt. Ltd. on the basis of RIO or mutually agreed terms within 30 days from today.

The prayer made on behalf of Star India Pvt. Ltd. was mainly to direct the respondent Asianet Digital Network Pvt. Ltd. to enter into an agreement w.e.f. 01.04.2018 on RIO basis because of failure to arrive at a negotiated agreement, the prayer in the other petition made on behalf of Asianet Digital Network Pvt. Ltd. was to direct Star India Pvt. Ltd. to renew/execute a fixed sum subscription fees agreement w.e.f. 01.04.2018 on non-discriminatory and reasonable rates in comparison to another MSO, M/s. ACCL.

Multi system operator (MSO) Asianet Satellite Communications has moved Delhi High Court against Telecom Disputes Settlement and Appellate Tribunal’s (TDSAT) order directing the company to either sign an reference interconnect offer (RIO) or negotiated deal with broadcaster Star India within a month.

The MSO had moved TDSAT seeking parity on the price at which Star gives content to other MSOs. However, the tribunal in its interim order asked the parties to negotiate and arrive at a consensus failing which the two have to enter into RIO based agreement.
