Associated Broadcasting Company Ltd ( ABCL) and VIL Media, the owners of Telugu news channels TV9 and V6 News, have moved Bombay High Court against the Broadcast Audience Research Council (BARC) India’s order suspending the ratings of the two channels.
Hindi news channel India News has already secured an interim stay on the BARC order from Bombay High Court.
BARC India had suspended the ratings of three channels, namely India News, TV9 and V6 News, for allegedly trying to influence ratings.
VIL Media challenged the order on 8 December while ABCL went to court on 9 December. The petitioners have prayed for interim relief from the BARC order.
The bench of Justice SJ Kathawalla has posted the matter for hearing on 13 December.
As reported earlier by TelevisionPost.com, India News had filed a petition in Bombay High Court citing BARC’s order as a breach of end-user license agreement dated 24 April 2015 and had sought a stay on the said order. It also claimed Rs 5 crore in damages from BARC for tarnishing its image.
While staying BARC’s 24 November order, the single bench of Justice SJ Kathawalla restrained BARC from acting upon or implementing the same. The court also noted that BARC’s order of suspension is arbitrary and illegal, without following the procedure prescribed in Clause 7 (e) of the agreement.
However, the bench also added that India News will have to undergo the balance suspension period stayed by this order if BARC, at the stage of the hearing of the notice of motion, is able to prima facie establish the breach on the part of the Hindi news channel.
