MUMBAI: The All India Digital Cable Federation (AIDCF) and Videocon d2h have filed applications to be impleaded in the tariff order case in the Madras High Court.
Distribution platform operators (DPOs) are in favour of TRAI’s draft tariff order, which has suggested MRP model for content pricing.
The Madras High Court had adjourned the hearing in Star India and Vijay TV’s petition against TRAI’s draft tariff order and interconnection regulation until 17 February, as senior counsel P Chidambaram, who is representing the two petitioners, was not available.
Star and Vijay have challenged TRAI’s jurisdiction to fix price of content. The two parties argue that TRAI has overstepped its jurisdiction and is not in compliance with the Copyright Act, which deals with all aspects of exploitation and monetisation of content.
TRAI in its reply to the HC had stated that the petition filed by Star India and Vijay TV is non-maintainable as the tariff order is still in the draft stage. It also stated that the HC does not have jurisdiction to hear this matter.
Meanwhile, TRAI had filed a special leave petition (SLP) in the Supreme Court, which allowed the regulator to frame regulations. Once framed, the same will have to be placed before the apex court. Meanwhile, the Madras HC can continue hearing the Star and Vijay appeals, the SC had stated.
