MUMBAI: The Advertising Standards Council of
India (ASCI) upheld 82 complaints against 124
advertisements it had received for the month
of April 2014.
Out of these 82 ads, 44 belonged to the
Personal and Healthcare category. As the
number of ads against which complained were
received was 46, the uphold rate in this
category exceeded 95 per cent.
The ASCI’s Consumer Complaints Council (CCC)
pulled up 44 advertisers as their ads were
found to be either misleading or false or not
adequately/scientifically substantiated and
hence violating the ASCI Code. Some of the
health care products also contravened
provisions of the Drug & Magic Remedies Act.
Some of the advertisers that were pulled up
are Hindustan Unilever Ltd, Bright Lifecare Pvt
Ltd, Kerala Ayurvedic Health Care, Marico Ltd,
Lotus Eye Hospital & Institute, Oriflame India
Pvt Ltd, Dr. Batra’s Homeopathic Clinic and
Godrej Consumer Products Ltd.
Complaints were also upheld against Tata Sky
Ltd for its advertisement of Tata Sky Karaoke
Application showing a male actor dressed in
blue T-shirt making fun of beggars who have
leprosy and are visually challenged. The
sequence happens when one lady in the ad is
singing and this actor starts imitating the
people whose hands get damaged by the
leprosy. The CCC concluded that the TVC
derides ‘people who have leprosy and people
who are visually challenged’ and shows them in
poor light.
An ad by Tata Teleservices Ltd for Tata
Docomo was also upheld as its onscreen
disclaimers were in very a small and illegible
font. The CCC concluded that the disclaimers/
supers in the TVC and the content/text shown
in the last frame of the TVC were illegible and
contravened the ASCI Guidelines on Supers.
According to the ASCI, print ads by 21
advertisers in the Education sector were not
substantiated and violated the ASCI Guidelines
for Advertising of Educational Institutions.
These included International Management
Institute (IMI) and Times Centre for Learning
Ltd.
Four ads were pulled up in the Food &
Beverages category which included ads by Pink
Papaya Foods Private Ltd, Rajguru Global
Private Ltd, Adani Wilmar Ltd and Naga Ltd.
The CCC also upheld complaints against Ascent
Meditech Ltd for its ad of Flamingo
Orthopaedic, Life Insurance Corporation for its
oral and video disclaimer; Vimal Pan Masala
for its radio ad; Jasper Infotech Pvt Ltd for its
ad of Snapdeal.com; ICICI Bank Ltd (Corporate
Banking Services) HDFC Bank Ltd for its ad of
HDFC Bank Personal Loan; Aschir Events for its
ad of Rang De; Marriot International for an ad
of Java+Courtyard; Lux Industries Ltd for Onn
Premium Wear; and Godrej & Boyce Mfg. Co.
Ltd for Godrej Locks.
