TataSky pays Rs 383 crore licence fee on gross revenue basis

NEW DELHI: TataSky today paid Rs 383 crore to the government as licence fee for the previous fiscal and arrears even as DTH operators and government are locked in litigation over licence fee structure.
The company said it submitted a demand draft of Rs 383 crore to the Ministry of Information and Broadcast (MIB). This amount covers licence fee for the year 2013-14 as per the rate specified for licence as well as past dues, for which the Ministry had raised a demand note recently.
"This payment is without prejudice to the court ... We would wait for the outcome of the order," TataSky CEO and Managing Director Harit Nagpal told PTI.
At present, the dispute between the various DTH operators and the government is still pending before the broadcast tribunal TDSAT.
"We hope that this will end the long standing dispute on the subject and pave the way forward for a constructive rationalisation of taxes with the support of our parent Ministry," Nagpal said.
The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) would hear the matter next month.
As per norms, a DTH operator has to pay around 10 per cent of their gross revenue to the government as their annual licence fee.
However, the DTH operators are contending that the MIB should charge licence fee based on adjusted gross revenue left after paying several taxes and others.

MUMBAI: Direct-to-home (DTH) player Tata Sky today said that it has submitted a demand draft of Rs 383 crore (Rs 3.83 billion) to the Ministry of Information and Broadcasting (MIB) towards licence fee for the year 2013–14 as per the rate specified for licence as well as past dues, for which the ministry had raised a demand note recently. Tata Sky MD and CEO Harit Nagpal said, “We hope that this will end the long-standing dispute on the subject and pave the way for a constructive rationalisation of taxes with the support of our parent ministry.” As reported first in TelevisionPost.com, the ministry had, in March this year, asked the DTH players to cough up pending licence fee dues amounting to Rs 2,066 crore (Rs 20.66 billion).

Out of this, Tata Sky’s dues were Rs 620 crore ( Rs 6.20 billion). The MIB had asked the players to submit the amount within 15 days, following which all the DTH operators had moved the TDSAT and got a reprieve till 6 May. The MIB had raised the licence fee demand based on Clause 3.1.1 of DTH licences. According to the said clause, gross revenue shall be calculated without deduction of taxes and agency commission, on the basis of billing rates, net of discounts to advertisers.

The six DTH operators had moved the TDSAT against the MIB’s upsetting licence fee demand. The operators had challenged the licence fee demand on the ground that the matter is sub judice as there are cases pending in the Supreme Court and the TDSAT. The DTH operators got interim relief on the ground that Clause 3.1.1 has been challenged before the apex court and is awaiting final disposal. The government counsel, however, argued that while the clause has been challenged in the SC, the same has not been stayed by the court.
