TDSAT issues bailable warrants against Sahara TV directors for flouting directions

MUMBAI: In a rare instance, the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) has issued bailable warrants against Sahara India TV Network directors Govind Tiwari and Devendra Kumar Srivastava for wilfully flouting the tribunal’s directions.
Petitioner Delhi Distribution Company’s counsel Vibhav Srivastava has been directed to give the name of the police station concerned where the warrants may be sent for execution. The matter has been put under the same heading on 22 December.
Sahara India TV Network directors were directed to appear before the tribunal and present details of movable and immovable properties of the company. The company was also directed to make payment towards the discharge of the decree.
However, despite the tribunal’s direction, none of the directors of the company was present, nor were the details of moveable and immoveable properties of the company filed or any payment made towards the discharge of the decree.
Sahara TV Network counsel Pankaj Agarwal stated that until yesterday afternoon, he was told that someone would reach him by the evening with a cheque to be handed over to the other party. In the evening, however, he was informed that no cheque would be forthcoming.
“From the earlier orders, it appears that the directors of the company are wilfully flouting the directions of this tribunal. The tribunal is, therefore, left with no option but to secure their presence through coercive measures,” the tribunal said in its order.
“The office is directed to issue bailable warrants of arrest against Mr Govind Tiwari and Mr Devendra Kumar Srivastava on the addresses being furnished by Mr Vibhav Srivastava, to ensure their personal appearance on the next date fixed in the matter.”
