Tata Sky Karaoke Service

Tata Sky has launched Karaoke service on its Direct to Home Television Platform (“Tata Sky Karaoke”). Tata Sky Karaoke is intended solely for Subscribers having a Tata Sky+ HD Set Top Box connection (hereinafter, the “Subscriber(s)” / “You” / “Your”).

Tata Sky Karaoke service allows the customer to enjoy Karaoke experience.

Unlike traditional Karaoke which shows only lyrics, Tata Sky Karaoke service showcases lyrics along with videos of song. Subscribers get a score on completion of singing a song based on his or her performance on the parameter of matching pitch with the song.

In addition to a Tata Sky+ HD Set Top Box connection (“TS+ HD”), the Subscribers who wish to subscribe to Tata Sky Karaoke Service will also need to have the related equipments / accessories including a Mic (“Mic set”) which can then be plugged into the TS+ HD. The Mic set can be bought by placing the order through Tata Sky’s Helpline.

The Offer Price(s) as stipulated below for Tata Sky Karaoke Services are inclusive of the cost of Mic set and annual subscription to the service.


Definitions:

“Subscription Video on Demand” or “SVOD” shall refer to the technique whereby the Content is pre-loaded via satellite on to the space reserved by Tata Sky in the hard disk drive (HDD) of your TS+ HD Set Top Boxes (STBs) with Personal Video Recorder (PVR) functionality with no fixed programming schedule upon payment of a Fee in the nature of subscription.

“Content” shall mean Karaoke enabled musical audio video content which will include vocal and / or non-vocal tracks with instrumental audio along with the display of lyrics on the television screen as well as meta-data for each of such musical video. Content shall also include relevant movie posters, images and graphics for promotional purposes.

Tata Sky Karaoke” shall mean the service which shall enable the user to listen, view and/or sing along in his/her voice with pre-recorded musical Content and can be enjoyed by way of subscription to the Tata Sky Karaoke Service on your TS+ HD combined with the Mic set.

Content and content delivery

Content for the service is provided by Hungama Digital Media Entertainment Private Limited (“Hungama”) who shall be responsible for any content related issues including intellectual property rights in the Content, quality and format, if so observed.
Tata Sky shall endeavour to make 60 songs available on service at any given time however Tata Sky reserves the right to revise the price and song offering
Content is delivered on the boxes via SVOD
Tata Sky shall endeavour to deliver the song packs through SVOD to TS+ HD regularly. Tata Sky shall not be held responsible for non-availability of song packs for Your Karaoke Service in case of failure of box to receive song packs for the reason of Your TS+ HD STB being in switched off/ power off mode or deactive stage for any known or unknown reason.

Warranty

Duration of warranty on the Mic set will be co-terminus with the warranty of Your TS+ HD. Accordingly, if Your TS+ HD is within its warranty period at the time of Your purchase of the Mic Set, the service warranty period of your Mic set will commence from the date of its purchase and end on the day the warranty of your TS+ HD.
In case warranty period of Your TS+ HD having expired or is less than One (1) month: One (1) month service warranty will be applicable on your Mic set from the date of its purchase.
In case You have two (2) TS+ HD connections, the service warranty period on the Mic set will be co-terminus with that of TS+ HD which is linked with the Mic set.
In case of any visit made by engineer to aid and assist in any trouble shooting w.r.t. Tata Sky Karaoke Service including the Mic set post its warranty period, a service visit charge of Rs. 150/- or as applicable from time to time along with any other charges including Mic set shall be payable by You.
In case any defect occurs in the Mic set post expiry of the warranty period, Tata Sky may, at its sole discretion, offer the Mic set in a subsidised rate.
In the event, You have already availed any promotional offer while subscribing to Tata Sky Karaoke service, Tata Sky shall have no obligation to make available the new Mic set for replacement at a subsidised rate.
If You wish to buy any additional Mic set, the same shall be offered at the prevailing rate at such relevant time.

General T&C

Tata Sky reserves the right, at anytime without prior notice, to add or vary all or any of these Terms and Conditions or to replace, wholly or in part any promotional offer / scheme with respect to the Tata Sky Karaoke Service or to withdraw it completely.
Tata Sky will not be liable for any loss, damage or cancellation of Tata Sky Karaoke Service caused by Force Majeure Events which are beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from activating this service.
Tata Sky shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Tata Sky website or process any transaction thereon.
You are not permitted to project the videos to any other screens using any external devices or any other manner and any such unauthorised act shall make You liable for violation of the Tata Sky Karaoke Service Terms & Conditions and / or any applicable laws.
Tata Sky shall not be held responsible for any fluctuations in the quality of video.
Tata Sky will not be responsible for the performance of the service if any Mic set other than one that is offered by Tata Sky is used with Tata Sky Karaoke service.
Tata Sky Karaoke service is meant for home and personal use only and cannot be used at public areas like restaurants, clubs, etc. unless specific prior written permission is obtained. Tata Sky and/or Hungama will not be responsible for any such unsolicited, unauthorised/commercial usage of the service.
All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract.
In the event of any inconsistency between the Subscription Contract and these Terms and Conditions, in so far as this Offer is concerned, the latter shall prevail.
You acknowledge and agree that all disputes in relation to the Tata Sky Karaoke Service shall be subject to exclusive jurisdiction of the Courts of Mumbai, India.
