While they continue to negotiate on the final terms of agreement, Star India and Hathway Cable & Datacom were directed by sector arbitrator Telecom Disputes Settlement and Appellate Tribunal (TDSAT) on Monday to follow an interim commercial arrangement. As per the interim arrangement, Hathway will pay Star at Rs 27 charge per subscriber (CPS) for all the entertainment and sports channels. Earlier, the MSO was paying separately for Star’s entertainment channels which were distributed by MediaPro. It had a fixed fee contract with MediaPro. The Star Sports channels were based on reference interconnect offer (RIO) basis. Hathway can now bundle the Star channels the way it wants. Star has a powerful bouquet of channels including Star Plus, Star Gold, Star Movies and Star Sports. Incidentally, Hathway had argued for Rs 22 CPS, while Star India had asked for Rs 31 CPS. The TDSAT has selected a middle path till a final order is given. The case will be next heard on 11 August. Meanwhile, Hathway is required to clear outstanding dues amounting to Rs 27 crore (Rs 270 million) by Wednesday. Last week, Hathway and Star Sports informed the TDSAT of their decision to enter into an agreement based on RIO.
