The Delhi High Court has issued a notice to the Ministry of Consumer Affairs directing it to file a response on a plea by direct to home (DTH) operator Tata Sky challenging the seizure of its set top boxes (STBs) for not declaring the maximum retail price (MRP) on them.

Detailed affidavit filed by TRAI which runs into 576 pages on February 6 without permission of court.

All of a sudden we are informed that on
6th February, 2019 a detailed affidavit on behalf of the Telecom Regulatory Authority has been filed which runs into 576 pages. Surprisingly, no application has been filed seeking permission or leave of this court to file such an affidavit. We are not impressed that in the midst of final hearing, such an affidavit is filed by the respondent without the leave of this court.

HC directs Centre to release Tata Sky STBs seized for not displaying MRP - Times of India

A bench of Chief Justice Rajendra Menon and Justice A J Bhambani, in an interim order, directed the Ministry of Consumer Affairs to release the over six lakh STBs it had seized in January, but allowed it to keep five of those for continuing with its probe. Issuing the direction, the bench said the government's decision was "prima facie arbitrary" and resulted not only in a financial loss to the direct broadcast satellite television provider, but also affected consumers who could not shift to the new STBs. "Here, the arbitrariness is writ large on the face of it," the bench added.
