MUMBAI: The Telecom Disputes Settlement & Appellate Tribunal (TDSAT) has directed headend-in-the-sky (HITS) operator Noida Software Technology Park Ltd (NSTPL) to pay Rs 1.2 crore (Rs 12 million) to Taj Television in three equal instalments within the space of two weeks each.
NSTPL operates its HITS service under JAINHITS brand.
The first instalment will have to be paid on 12 May, the second on 26 May, and the third on 9 June.
The tribunal said that the amount would also carry interest @14 per cent per annum computable from 29 April till the last payment on 9 June.
It added that the payment would not absolve NSTPL from making payment of the monthly subscription fee for the coming months of May and June 2015 on time.
The tribunal said that in case of any default in payment of the instalments, Taj would be free to discontinue the supply of its signals without any further direction from the tribunal.
It also asked the two sides to hold a reconciliation of accounts and directed the petitioner to give its explanation with regard to the discrepancies in the system based on which the respondent had raised the larger claim of over Rs 2 crore (Rs 20 million).
The matter has been put up under the same heading on 15 July. In the miscellaneous application (MA), Taj counsel Tejveer Singh Bhatia claimed dues of Rs 3.49 crore (Rs 34.9 million) up to 31 March 2015 from NSTPL. Out of this amount, Rs 1.2 crore (Rs 12 million) is the subscription fee invoiced up to 31 March 2015.
