DTH operator Dish TV settled its differences with Sun Network as per the order of the Telecom Disputes and Settlement Appellate Tribunal (TDSAT), accessed by DreamDTH. The two parties have settled via a settlement term recorded in two emails date 16.10.2019.
In October, Dish TV had moved TDSAT to seek protection against any coercive action that could be taken by the broadcaster. The parties had then agreed to have a meeting to work out a schedule for payment of the outstanding dues by Dish TV.
The said meeting was to be held the day after the first hearing. The tribunal had posted the matter on a later date after the broadcaster assured of not taking the coercive option. The next hearing took place a day after the settlement terms were shared via email but both parties asked for a short adjournment as they were yet to settle.
In the final hearing, both the parties told the court that they had concluded a settlement agreement and since nothing survives for adjudications prayed for the withdrawal of the petition. The broadcaster prayed for a copy of the settlement agreement be taken on record and it may be indicated that if the terms of the settlement are violated, parties will be at liberty to take action in accordance with the law.
Disposing of the petition, Hon’ble Mr. Justice Shiva Kirti Singh ruled
” Let the settlement terms recorded in two e-mails dated 16.10.2019 be taken on record. In case of violation of terms of the settlement, the parties will be at liberty to take action in accordance with law.”
