If TS really want TP back in 2008 then they could move to any foreign sat without any delay just like other DTH did. So I think they didn't move to foreign sat earlier. And from business point of view their decisions was not wrong as they have second largest subscriber base with only around 250 channels. Now I don't think TS really want new TP as of now until INSAT 4A ends. Because they already have started MP4 migration process so that they can increase channels count to around 500 from their 12 TP.
You were right when you said Tata Sky should have moved to another foreign satellite. They paid the price for staying with the indigenous satellite.
The TP price difference between Indian and Foreign satellites wouldn't be huge. If it were huge, it would dent the profits of the other DTH players and all the DTH players would fight for Indian Satellite TPs, which would result in Indian Government to put TPs to auction as well. INSAT-4CR has 12 high-power Ku-band transponders; GSAT-8 carries 24 Ku-band transponders; GSAT-10 carries 12 Ku-band transponders and the recently launched GSAT-14 will add 6 ku-band transponders when it becomes operational. And why is still every DTH happy with foreign satellites.
Coming to the addition of DD channels, it's not a matter of will. Tata Sky is not switching to MPEG4 just for the sake of it, it was forced to do so because the 'glorious current government' (isro) did not release the TPs promised for the Tata Sky ages ago. The freed TP space that Tata Sky now has didn't come out of no where. It has made significant investments to shift to the MPEG4. Thus it is upto TS whether to add DD channels or not. The government now can't say - hey go to some foreign satellite and broadcast DD channels - or - hey since you freed-up some space recently, why not add DD channels.
If the government gave the promised TPs, Tata Sky has no need to shift to MPEG-4 and thus save a lot of money And would happily add DD channels. Dish TV is still on MPEG-2 for all of its SD channels using NSS-6 satellite. The government should return the advanced booking fees paid by the Tata Sky before they ask TS to carry DD channels. or TS can approach the court of law.
The current Indian Government is famous for issuing useless regulations. Instead of making the DD channels mandatory, why not regularize the other important issues that are plaguing the DTH consumer today.
Clause 7.6 of the DTH licence mandates that "every DTH has to provide access to various content providers/channels on a non-discriminatory basis". Now, when government issues such a clause, it SHOULD also SELL (or show a way to buy) all the TP space required for all the DTH providers to "provide access to various content providers/channels on a non-discriminatory basis". - OR - it should formulate ANOTHER CLAUSE on how to discriminate among channels if there is a TP space scarcity.
