Sun TV moves SC against property attachment by ED

MUMBAI: Kalanithi Maran-promoted Sun TV Network has moved the Supreme Court against the Enforcement Directorate’s (ED) decision to attach its assets worth Rs 742.58 crore (Rs 7.43 billion).

A bench headed by chief justice H.L. Dattu said that they would pass appropriate orders when the case comes up for consideration, according to a report in Mint.

Sun TV has contended that the case does not fall within the ambit of the 2G spectrum scam case.

Earlier, the Madras High Court had dismissed petitions filed by Sun TV and Kal Communications challenging the attachment of their properties by the ED in the Aircel-Maxis case.

The bench of Justice M. Sathyanarayanan had said that he was not inclined to entertain the plea since the case is being monitored by the Supreme Court. The bench directed Sun TV Network and Kal Communications, the cable TV arm of the Sun Group, to approach the Supreme Court.

Senior counsels Kapil Sibal and P S Raman, appearing on behalf of Sun TV and Kal, had contended that the properties were acquired much before probe into the Aircel-Maxis case started.

They also questioned as to why the properties of other firms accused in the case had not been attached.

Additional Solicitor General G. Rajagopalan argued that that the Supreme Court was monitoring the case and hearing the matter by any other court would impede the investigation.

Sun TV and Kal Communications had moved Madras High Court for quashing of ED’s 31 March attachment order in the Aircel-Maxis deal case. The High Court reserved its orders on the petitions.

ED had attached bank deposits and properties worth over Rs 742.58 crore (Rs 7.43 billion) in the name of Dayanidhi, his brother Kalanithi and other family members under the Prevention of Money Laundering Act.
