The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has directed Independent TV to take steps to pay the dues of Indiacast Media or face execution of judgement and decree.
The tribunal heard both the parties and perused the last order passed in the previous hearing. Independent TV’s counsel admitted to not having paid any payment towards the admitted liability of Rs 3.56 crores within the two months granted.
The court noted that Independent TV had to disclose its entire assets by the hearing date if it failed to make the payment, which wasn’t done. Taking strong objection to the defiance, the court remarked that it amounted to willful disregard of the order and attracted the provision for penalty for such disobedience.
It granted three weeks time for the shutdown DTH operator to file an entire list of assets on affidavit as required by provisions in Order XXI Rule 41 of CPC which prescribes a format for that purpose and noted that the actual amount of penalty shall be governed by further action.
Posting the matter under the same head on 4.2.2020, TDSAT Chairperson Hon ble Mr. Justice Shiva Kirti Singh noted, “It is expected that respondent shall take steps to pay the admitted dues by the next date, otherwise suitable orders for execution of judgment and decree for the admitted amount shall be passed.”
