keralavision is offering 11 Malayalam channels in a basic pack of 100 channels. Most of them are either cable operators own channel or shopping channel. They have another pack of 150 channels where they offer 37 FTA Malayalam channels. Why can't they offer the 37 channels in the basic pack?
As per TRAI order, we're free to choose 75 of initial 100, every MSO will define a Basic Service Tier (BST), its upto us to take it or not, we can insist the channels that we want instead of the BST offered

“television channel” means a channel, which has been granted downlinking permission by the Central Government under the policy guidelines issued or amended by it from time to time and reference to the term “channel” shall be construed as a reference to “television channel" Tariff order Page 6, definition (zh)
Wonder how many Or Do any if the LCO or MSO channels fit in the definition of Channel as stated by TRAI, so how or why should they be included or be a part of the Network Capacity subscribed for.

If they don't give you a choice to choose channels you need to go to consumer court Its your right

Its true, but do you think a layman customer know that choice option or will the LCO give that choice. They will promote only their packs. Even though the set-top box is mandatory most of the local cable guys don't have the resource and infrastructure to key in customer wise options. 90% of the customers pick what the cable operator or DTH offer as packs. Now onwards LCO/DTH will try the maximum to push the maximum number of FTA channels to customers as they will get NCF.

Now DTHs won't be able to charge their service channels like movie channels, +1 services etc.
 
TRAI sec is giving reference of BARC rating acc. to which the most watched channel in India is Sun TV (tamil channel), which we all know can't be true as no. of tamil speakers or people who can understand tamil is very few if we compare to no. of people who can understand Hindi/Hindustani,bangla, telugu or marathi.
So, the thing is that you can not get right results when your reference it self is not accurate.

A layman customer, if he's in front of a TV, he would have seen the advert running on every TV channels 100 times or even more, every subscriber would be knowing that TV viewing is going to change by 29th, on top of it, not many popular channels are FTA, an LCO/DTH might go hard to protect their business but awareness is one of the Key behind this effort from TRAI, NCF, as it is, DPO's are going to earn, but steadily people will learn to subscribe only to what they really watch.
