Bennet Coleman vs TRAI

  • Benett Coleman highlighted that certain informations in respect of pre-existing agreements have been asked for and are required to be submitted to the Authority within seven days.
  • From the submissions it further appears that the real objection to submitting the required relevant details is mainly in respect of consideration amount for the relevant agreement.Accordingto learned senior counsel, the commercial details should not be asked for at this stage unless its relevancy is decided. He has also raised the issue of jurisdiction.
  • TRAI points out that in the last sentence, the Authority has asked for only the details of the parties to the agreement, the territory, agreement period and other relevant details and there is no specific demand for the consideration amount in respect of the agreement.
  • In view of above noted submissions, we (TDSAT) permit the appellants (Bennet Coleman) to submit the required details of the pre-existing agreements but without disclosing the consideration amount. That should be done without any delay. The seven days period is extended by another period of five days from today for the aforesaid purpose.

Isnt this order applicable to Jio TV ???
Yes Jio TV may not be free any more after Trai order implementation as till now they have signed contract at very less rate to make mobile TV popular and sell Thier Sims, but now they may ask Rs 150-200 per month separate recharge to watch TV in mobile that I think

JioTV is an OTT and I think TRAI rules are not applicable to OTT. Government is in process to bring out rules for OTT.
