Benett Coleman highlighted that certain informations in respect of pre-existing agreements have been asked for and are required to be submitted to the Authority within seven days.
From the submissions it further appears that the real objection to submitting the required relevant details is mainly in respect of consideration amount for the relevant agreement.Accordingto learned senior counsel, the commercial details should not be asked for at this stage unless its relevancy is decided. He has also raised the issue of jurisdiction.
TRAI points out that in the last sentence, the Authority has asked for only the details of the parties to the agreement, the territory, agreement period and other relevant details and there is no specific demand for the consideration amount in respect of the agreement.
In view of above noted submissions, we (TDSAT) permit the appellants (Bennet Coleman) to submit the required details of the pre-existing agreements but without disclosing the consideration amount.That should be done without any delay. The seven days period is extended by another period of five days from today for the aforesaid purpose.
