Basic tier pack that TRAI likes so much is already dead on arrival because many good FTA channels are now pay channels. The mandatory 74 slots remaining after 26 DD channels will mostly be used by subscribers for top broadcaster's pay bouquets and few alacarte FTA channels and not for basic tier pack. However TRAI rules will still be good because useless channels will not get subscribed and will go out of business. The competition among channels will therefore increase which will be good for subscribers.

Only few remaining FTA channels of top broadcaster are converted to pay. Most regional, carriage fee (news and movie) channels are still FTA. The main reason is that top broadcasters don't want to bundle their channels with other FTA channels in basic tier pack. TRAI new order says that FTA and Pay channels cannot be in same bouquet. So by making it pay they can include all their channels in same pack. This move will not cause a price rise because they are still costing only Rs.1. The tactic is solely to make pay bouquets superior to FTA bouquets.
 
Some networks are given discount @50% for bundles, but as per TRAI, discount upto@15%. Is it possible discount @50% after Supreme court verdict?

"The initial tariff order stipulated that the discounts on MRP of a bouquet should not exceed 15% of the cumulative individual channels’ cost. However, this clause was rejected by the Madras High Court and was not challenged by TRAI in the Supreme Court. Hence, the clause of 15% discount cap on bouquet compared to a-la-carte price has been rejected. It may be noted that most broadcasters who have declared RIO rates are offering discounts much higher than 15%, as it is now allowed. This would mean that the tariff order would eventually not have much impact on the overall regime."
Although most regulations were largely neutral to broadcasters/distributors, the removal of the 15% discount cap on pricing of channel bouquets would mean that the new TRAI regulations particularly pertaining to bouquet pricing are practically futile and the old regime would continue on broadly similar terms in the new tariff regime,” says Rohit Dokania, Research Analyst, IDFC Securities Limited
