1. Tata Sky Limited (Tata Sky) has introduced an
Offer whereby the existing subscriber, if
contacted by Tata Sky, can get a Tata Sky High
Definition Connection and a waiver of two (2)
months Tata Sky High Definition Access Fee.
2. This Offer applies to only those existing
subscriber of Tata Sky who have been
contacted by Tata Sky during the Offer Period
and who are:
1. Holding a Tata Sky Standard Definition
Connection; and
2. Are willing to return the existing Set Top Box;
and
3. Are willing to pay Tata Sky a sum of Rs 590 for
each Tata Sky High Definition Connection
either through credit card or debit card or net
banking or cash on delivery.
3. This Offer is only for the period April 15, 2014
to 31 July 2014.
4. This Offer cannot be availed through dealers or
by existing subscribers who haven’t been
contacted by Tata Sky.
General Terms and Conditions:
1. This Offer can be availed only for a maximum
of four (4) Tata Sky High Definition
Connections by paying Rs 590 for each Tata
Sky High Definition Set Top Box and returning
equal number of Tata Sky Standard Definition
Set Top Box.
2. The Offer is available only on returning the
existing Tata Sky Standard Definition Set Top
Box.
3. The special prices of Rs 590 is inclusive of box
buyback credit and therefore, no exchange
bonus will be credited to subscribers’ account
upon returning the Tata Sky Standard
Definition Set Top Box.
4. All Tata Sky High Definition Connections
bought under this Scheme will have 12 months
all inclusive service commitment. The 12
month period shall commence from date of
activation of Tata Sky High Definition
Connection at Rs 590 purchased through this
Offer.
5. This Offer is not redeemable for cash
equivalent or any other items/offeRs
6. The Tata Sky High Definition Set Top Box and
the other Consumer Premise Equipment under
this Offer (together referred to, as the ‘Tata
Sky Hardware’) is provided to the subscriber(s)
only on entrustment basis without any
consideration and Tata Sky shall continue to
retain perpetual full legal and equitable
ownership rights over the Tata Sky Hardware.
7. The selected subscriber(s) must pay the entire
amount of Rs 590 towards the Tata Sky High
Definition Connection. The transaction will not
be completed in the event the entire amount is
not paid by the selected subscriber(s) or the
Tata Sky Standard Definition Set Top Box is not
returned by the selected subscriber (s).
8. This Offer cannot be clubbed with any other
facility and/or offer made available on
http://www.tatasky.com or Tata Sky Helpline or
through an offeRs
9. Tata Sky reserves all rights to make
amendments to the terms and conditions of
this Offer or completely withdraw the Offer at
any time for any reason whatsoever without
any prior notice to the subscriber.
10. By availing the Offer, it shall be deemed to be
construed that the subscriber shall comply
with the terms and conditions of the Offer. The
subscriber agrees to release, indemnify and
hold harmless, Tata Sky, its respective
affiliates, its advertising and promotion
agencies, and all of its respective agents,
representatives, officers, directors,
shareholders and employees from and against
any injuries, losses, damages, claims, actions,
or any liability of any kind resulting from or
arising from your or any third party’s use (or
misuse) of the Offer.
11. The terms of the Offer shall be construed in
accordance with the laws of India and the
courts of New Delhi shall have sole and
exclusive jurisdiction to adjudicate and/or
settle any disputes in connection with the
Offer.
12. These terms and conditions are in addition to
the terms and conditions of the Subscription
Contract and in the event of any
inconsistencies between the two, the terms of
the Subscription Contract shall be binding.
These terms and conditions shall not constitute
a modification or waiver of any other provision
of the Subscription Contract. Terms used
herein but not defined shall have the same
meaning as assigned to them in the
Subscription Contract.
13. Tata Sky reserves the right to forfeit the Offer
in the event it is found by Tata Sky that any
information provided by the subscriber (s) is
wrong or any misrepresentation is made by the
reader(s)/subscriber (s).
14. This Offer is subject to force majeure
circumstances i.e. Act of God or any other
circumstance beyond the control of Tata Sky
such as technical failures in the telephone
lines, failure of servers or any mistakes arising
out of technical snags.
15. By availing this Offer, it shall be construed
that the subscriber has read, understood,
accepted and agreed to abide with all the
terms and condition stated hereunder.
